1. Purpose
These General Terms and Conditions of Sale (GTCS) govern the private chef services offered by Gaëlle Battistuta, a sole proprietor, trading as Gaëlle Battistuta – Private Chef, to private clients.
They apply to any service covered by a quotation accepted by the client.
2. Quotations and Bookings
Each service is subject to a quotation specifying, in particular, the nature of the service, the number of guests, the selected menu, any additional services, applicable travel expenses and the total amount.
The booking is confirmed once the quotation has been accepted and a deposit of 50% of the total amount has been paid.
Acceptance of the quotation constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.
3. Prices and Payment Terms
The prices displayed on the website are indicative prices. The final price of the service is the amount stated in the accepted quotation, determined in particular according to the number of guests, the selected menu, any specific requests and the conditions of the service.
A 50% deposit is due upon confirmation of the booking.
The remaining balance must be paid no later than 5 days before the date of the service.
Payment must be made by bank transfer using the bank details provided on the quotation or invoice.
An invoice will be issued to the client in accordance with applicable legal requirements.
4. Menus and Product Availability
Menus are created according to the seasons, product availability and supplies from our suppliers.
A particular ingredient may occasionally need to be changed in the event of unavailability, supply shortages or insufficient quality of the product originally planned.
In such cases, the ingredient concerned may be replaced with a product of equivalent quality and nature, while maintaining the spirit and balance of the menu.
Any significant change requested by the client after the quotation has been approved may result in a price adjustment.
5. Allergies, Intolerances and Dietary Requirements
The client must inform Gaëlle Battistuta, when requesting a quotation and no later than before accepting the quotation, of any allergy, intolerance or dietary restriction affecting any of the guests.
This information will be taken into account insofar as it is compatible with the nature of the service and the availability of suitable products.
Information provided at a later stage may require the menu to be adapted and, depending on the circumstances, may result in a price adjustment or make certain proposals impossible to provide.
6. Changes to the Number of Guests
The number of guests stated on the quotation forms the basis of the service and the calculation of the total amount.
Any change to the number of guests must be communicated as soon as possible and may result in a revised quotation.
Any reduction in the number of guests made less than 7 days before the service may not entitle the client to a refund of the corresponding amount already committed, or may result in the original price being maintained, particularly where purchases or preparations have already been made.
Any increase in the number of guests remains subject to the feasibility of the service and product availability.
7. Postponement or Cancellation by the Client
Any request for postponement or cancellation must be made in writing.
In the event of cancellation by the client:

More than 7 days before the service: cancellation is free of charge and the deposit will be refunded;

Between 7 days and 48 hours before the service: the 50% deposit is retained;

Less than 48 hours before the service or on the day itself: the full amount of the service is due.
In the event of postponement, a new date may be proposed subject to the chef’s availability and the conditions of the service.
In exceptional circumstances, including force majeure, the situation may be considered on a case-by-case basis.
8. Cancellation or Inability of the Chef to Provide the Service
In the event that the chef is unable to provide the service due to illness, accident or another major impediment, a new date may be offered by mutual agreement.
If no alternative date can be agreed upon, all amounts paid by the client for the service will be refunded in full.
The chef shall not be held liable where the inability to provide the service results from an event of force majeure.
9. Conditions for Providing the Service
The client agrees to provide access to the premises and the equipment necessary to carry out the service under the conditions agreed upon at the time of booking.
The service hours are determined according to the nature of the service.
Any delay or circumstance attributable to the client that results in additional service time may give rise to an additional charge where such a charge is provided for in the quotation or accepted by the client.
At the end of the service, the areas and equipment used will be left in the condition specified in the quotation.
10. Consumer Mediation
In the event of a dispute that cannot be resolved amicably following a prior written complaint, any private client may have free access to the consumer mediator appointed by the business, in accordance with Article L.612-1 of the French Consumer Code: CM2C.
11. Personal Data
Personal data provided as part of a contact request, quotation or booking is processed in accordance with the Privacy Policy available on the website.
This data is used in particular to respond to enquiries, prepare quotations, organise services and manage the ongoing client relationship.
The client may exercise their rights in accordance with the conditions set out in the Privacy Policy.
12. Applicable Law
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the parties agree to seek an amicable resolution as a priority.
If no amicable agreement can be reached or consumer mediation is not pursued, the dispute shall be referred to the competent courts in accordance with the applicable rules of ordinary law.
